One type of residence permit that foreign nationals can use to conduct activities in Indonesia is a Limited Stay Permit (ITAS). Based on Article 31 of Government Regulation No. 32 of 1994 concerning Visas, Entry Permits, and Immigration Permits, a Limited Stay Permit is an immigration permit granted to a foreigner to reside and be present in the territory of the Republic of Indonesia for a limited period.
A Limited Stay Permit is granted to a foreigner entering or residing in Indonesia for a specific purpose that requires an extended stay.
Limited Stay Permits have varying durations depending on the application. The shortest period is 30 days, and the longest is 2 years. Furthermore, an ITAS can be extended up to five consecutive times. However, this does not apply to limited stay permits derived from a 30-day limited stay visa. So, who can obtain a Limited Stay Permit?
In accordance with Article 52 of Law No. 6 of 2011 concerning Immigration, Limited Stay Permits are granted to:
- Foreigners entering Indonesia with a limited stay visa and holding a limited stay visa at the time of arrival;
- Children born in Indonesia at the time of birth of their father and/or mother holding a limited stay permit;
- Foreigners granted a status change from a visit stay permit;
- Captains, crew members, or foreign experts on board ships, floating equipment, or installations operating in Indonesian waters and jurisdictions in accordance with statutory requirements;
- Foreigners legally married to Indonesian citizens; or
- Children of foreigners legally married to Indonesian citizens.
To apply for a limited stay permit (ITAS), the foreigner’s guarantor must register online through the migrasi.go.id
